These terms explain how I work, how you pay, and what each of us can expect. I've kept them in plain English. If anything is unclear, email me at contact@dromeda-dev.com before you buy.
1. Who these terms are between
These terms are between Dromeda Development ("I", "me"), a one-person studio run by Dante, and the business buying the service ("you"). My services are for businesses, not for personal or household use.
2. How you accept these terms
Fixed packages. When you buy a fixed package (Mobile Rescue, Speed Sprint, Get Found Locally, Emergency Site Rescue or The Full Fix), you accept these terms by ticking the terms box at checkout and completing payment. You don't need to sign anything else.
Custom work. Custom projects are agreed in a written Scope of Work signed by you and by me. These terms apply to every signed custom Scope of Work.
Electronic records. You agree to do business with me electronically. Ticking the box at checkout, or approving something in writing by email, has the same effect as signing on paper. You can ask for a copy of these terms and your Scope of Work by email at any time.
Authority. The person accepting confirms they're authorized to act for the business.
3. The work
The work is exactly what your Scope of Work ("SOW") describes: deliverables, exclusions, turnaround and how the work is approved. For fixed packages, the SOW is the package description I send you. If these terms and the SOW conflict, the SOW controls for the work it describes.
4. Price and payment
Every package has a fixed price. I never bill hourly. All prices are in US dollars.
| Package | Price | How you pay |
|---|---|---|
| Mobile Rescue | $550 | In full at checkout |
| Speed Sprint | $450 | In full at checkout |
| Get Found Locally | $750 | In full at checkout |
| Emergency Site Rescue | $400 | In full at checkout |
| The Full Fix | $1,400 | In full at checkout, or a $700 deposit at checkout and a $700 balance |
- The Full Fix in two payments. The $700 deposit schedules the work. The $700 balance is due when you approve the work (section 7). I send the balance as a checkout link, and it's due within 7 days of that link.
- Custom work. Paid on the schedule in the signed SOW.
- How you pay. Through a secure Stripe checkout link. Stripe handles your card details; I never see or store your full card number.
- Unpaid balances. I may pause the work or hold back handover until a balance is paid.
- Taxes. Prices don't include any tax that may apply.
- Third-party costs. Hosting, domains, paid plugins, apps, listings and other third-party fees are yours, and you pay them directly. I won't buy anything on your behalf without your written OK.
5. Your responsibilities
- Give me the access the onboarding email describes, using your platform's own user invites with the least access the work needs. Never send me passwords by email.
- Confirm that you own, or have the right to change, the website, accounts, content and images involved.
- Answer my questions within 2 business days. The turnaround pauses while I'm waiting on you.
- Keep your own accounts (hosting, domain, Google and others) in good standing.
- If you haven't given me access within 30 days of paying, I may treat the project as cancelled under section 9.
6. Turnaround
Turnaround is counted in business days (Monday to Friday, excluding US federal holidays), except Emergency Site Rescue, which is counted in hours. The clock starts when your access is confirmed. Turnaround times are estimates and pause while I'm waiting on you or on a third party (your host, a platform, Google).
7. Revisions and approval
- One revision round. After delivery you may send one consolidated list of changes that fall inside the SOW, and I'll make them.
- Approval. When the work is done I send you a before/after report and ask you to approve it. Approving in writing (a reply by email is fine) accepts the work.
- If something's wrong. If a deliverable doesn't match the SOW, tell me in writing before you approve and I'll fix it.
- If I don't hear back. If you haven't approved the work or told me what doesn't match the SOW within 5 business days after delivery and a reminder, the work is treated as accepted and any balance becomes due.
8. Changes to the scope
Anything not in the SOW is a change. Before I do any change, I'll send you a written description, a fixed price and a timeline. Nothing changes until you approve it in writing. Each approved change becomes a numbered change order that is part of the SOW and follows these terms.
9. Cancellations and refunds
- Before work starts (before your access is confirmed): you may cancel for a full refund of what you paid.
- After work starts, before delivery: you may cancel, and I'll refund what you paid minus the value of the work already done. I'll explain that amount to you in writing.
- Emergency Site Rescue: work starts right away, so it isn't refundable once diagnosis has begun, unless I can't identify the cause of the outage. In that case you get a full refund.
- If I can't deliver. If I can't complete the SOW for reasons within my control, you get a refund for the parts I didn't deliver.
- After approval: no refunds. The revision round covers anything in scope that isn't right.
- Refunds go back to the original payment method. To ask for one, email contact@dromeda-dev.com.
10. What I don't promise
- No guaranteed results. Search rankings, speed scores, traffic and sales depend on things outside my control, including Google, your host and third-party tools. I promise to do the work in the SOW with care and to report measured results honestly. I don't promise any particular score, ranking or business outcome.
- Third parties. I'm not responsible for outages, changes or policies of hosts, platforms (WordPress, Wix, Squarespace, Google and others), plugins, apps or domain registrars.
- Security. Hardening reduces risk. No website can be made completely secure.
- No other warranties. Except as written in these terms and the SOW, the work is provided as is, and I disclaim implied warranties, including merchantability and fitness for a particular purpose, to the extent the law allows.
11. Backups
I take a backup before I change anything. You remain responsible for keeping your own backups. I keep my copy for 30 days after handover and then delete it.
12. Limit of liability
To the extent the law allows:
- My total liability for anything arising from the work or these terms is limited to the amount you paid me for the SOW the claim relates to.
- Neither of us is liable for indirect, incidental, special or consequential damages, including lost profits, lost revenue or lost data, even if warned they were possible.
- These limits don't apply to fraud, willful misconduct, or anything the law doesn't allow to be limited.
13. Ownership
- Your things stay yours. Your website, content, logos, images, accounts and data remain yours.
- The work. Once you've paid in full, the changes I make to your site are yours to use and modify. For custom work, the ownership section of the signed SOW applies.
- My tools. General know-how, scripts, templates and tools I use across projects stay mine. Where they're built into your site, you get a permanent license to use them on that site.
- Open-source and third-party code stays under its own license.
14. Confidentiality and access
I keep your non-public information and access confidential and use it only to do the work. At handover you remove my user accounts, and I confirm my access no longer works. How I handle personal information is explained in my Privacy Notice.
15. Showing your project
I won't use your name, logo, quotes or project results in my marketing unless you give me written permission. You can withdraw that permission at any time.
16. Ending a project
Either of us may end a project in writing if the other seriously breaks these terms and doesn't fix it within 10 days of notice. If a project ends early, section 9 applies, and sections 4 (for unpaid amounts), 10, 12, 13, 14 and 17 continue to apply.
17. General
- Governing law. Massachusetts law governs these terms. Any dispute goes to the state or federal courts located in Massachusetts, including small claims court where it qualifies.
- Notices. By email: to me at contact@dromeda-dev.com, and to you at the email you used at checkout.
- Independent business. I'm an independent business, not your employee or agent.
- Entire agreement. These terms, your SOW and any approved change orders are the whole agreement between us.
- Changes to these terms. I may update these terms for future purchases. The version you accepted applies to your project.
- Severability. If any part of these terms can't be enforced, the rest still applies.
